Acceptance of the General Conditions of Sale

Art. 1 General Provisions

The contract (as defined: distance contract pursuant to art. 50 et seq. of Legislative Decree 6 September 2005, n.206 "Consumer Code") stipulated between AgriBio Servizi SRL and the Customer, is intended as concluded with the acceptance, even partial, by AgriBio Servizi SRL of a purchase proposal issued by the Customer, via the Internet, on the website This acceptance is considered tacit, unless otherwise communicated to the Customer by appropriate means.

By placing an order, the Customer declares: 1) to be a consumer in accordance with the provisions of the art. 3 of the Consumer Code; 2) to be of age; 3) that the data provided by the same for the execution of the contract are correct and truthful; 4) to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions indicated in the purchase procedure.

DISCLAIMER OF LIABILITY . In the event of non-acceptance, even partial, of an order by AgriBio Servizi SRL, any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things.

DISCLAIMER . The information on the products provided by the AgriBio Servizi SRL online shop is to be understood as simple generic information material and in no case constitutes medical advice or opinion.

Art. 2 Purchase methods

The Customer is guaranteed only and exclusively on the purchase of the products present in the electronic catalog of the Agri.Bio.Peimonte online shop at the time of placing the order and viewable online at the address (URL) http://www.agribioshop. it/. It is also specified that the images relating to the descriptive sheet of a product may, in some cases, not be perfectly distinctive of its characteristics but may differ in some particular cases, such as dimensions, colours, other particular accessories or details possibly presented in the figure being purely for illustrative purposes.

COMPLETION OF THE CONTRACT . The contract is concluded by communicating to the Customer (who has formulated a purchase proposal by providing the data necessary for the registration procedure of his name, purchase order and chosen payment method) that the proposal has been accepted. Correct receipt of the order is confirmed by AgriBio Servizi SRL via e-mail response sent to the e-mail address communicated by the Customer at the time of the order. The 'Customer Order Number' reported in the confirmation message together with the date and time of receipt of the order, will be used in any further communication with the AgriBio Servizi SRL online shop. The Customer undertakes to verify the correctness of all data entered according to the methods described in this document and to promptly communicate any corrections.

FAILURE TO ACCEPT . In the event of non-acceptance of the order, for any reason, AgriBio Servizi SRL guarantees timely communication to the Customer by the appropriate means.

PRODUCT AVAILABILITY . All the products on sale and present in the electronic catalog of the AgriBio Servizi SRL online shop are available for purchase but this does not mean that they are ready for delivery in our warehouses. Furthermore, if the product is available at the time of purchase there could be an unexpected unavailability of supplies by the producers and/or suppliers of the AgriBio Servizi SRL online shop, due to IT errors, stock outages, unannounced stock depletion, failure to deliver due to carrier strike, non-conformity of the product at the time of receipt and other causes not foreseeable at the time of acceptance of the order. In each category of the online shop there are general waiting times and many products explicitly report supply times. AgriBio Servizi SRL reserves the right to partially refund the order for any unavailable items or totally refund the order in the event that the missing reference is the only one constituting the order itself. All the seeds in the professional bags (meaning all the seeds that are packaged differently from the classic hobbyist bags, therefore defined differently from "maxi bag" or "sachet"), are intended as "goods packaged to measure" and to give the customer the maximum germination, quality and freshness, are packaged at the time of the order placed by the customer to AgriBio Servizi SRL and then in turn from AgriBio Servizi SRL to the supplier, they are not available immediately but there may be 10 to 15 working days for delivery. PRODUCT TYPE . AgriBio Servizi SRL as an association of organic and biodynamic producers and consumers resells certified organic, biodynamic and untreated products. The chosen product will be sent to the customer and added to the cart as per his request. It is therefore necessary to pay close attention when reading the product sheet where the type of certification is shown so that you can choose the product that best suits your needs. If the product does not show the type of certification, and you are not sure of the type of certification of the product, you must find out by contacting us before purchasing the product, making sure that the product shows the type of certification, before placing an order. INVOICE . For each order placed on the AgriBioShop online shop, only and exclusively if the Customer has expressly requested it at the time of the order in the 'Notes' and has provided a valid VAT number and valid Tax Code when registering the Customer's Account, AgriBio Servizi SRL issues an invoice for the material shipped, sending it via e-mail to the order holder or inserting it directly into the package. If an invoice has not been specifically requested, a regular receipt will be issued and once issued it will no longer be possible to request an invoice.

Art.3 Delivery of products

AgriBio Servizi SRL accepts Customer orders both for the quantities of existing products in stock and for products not in stock. AgriBio Servizi SRL undertakes to promptly communicate to the Customer any unforeseeable stock runs out and the time required to receive the reference not in stock. In order to maintain the efficiency of the service and if the conditions arise, AgriBio Servizi SRL reserves the right to use an express courier different from the one chosen by the Customer at the time of completing the order.

AgriBio Servizi SRL delivers the products to the address indicated by the Customer within the times established by the shipping details by courier or in any case within a maximum of 30 (thirty) days from the conclusion of the contract except for products that explicitly report deliveries of the products in specific periods of the year . No responsibility can be attributed to AgriBio Servizi SRL in the event of a delay in processing the order or in delivering what was ordered in the event of shortcomings or defaults on the part of the delivery courier.

DELIVERY COSTS . Delivery costs are borne by the recipient and explicitly highlighted when placing the order. There are no free shipping costs above a certain amount. The only way not to have them charged is to come and collect the goods at our headquarters in Via Generale Cappa 45, Dogliani (CN) 12063.

TIME OF DELIVERY . Upon delivery of the goods by the courier, the Customer is invited and in any case required to check:

that the number of packages actually delivered corresponds to that indicated on the consignment note;

that the packaging of the packages is intact in all its parts, not damaged or compromised by atmospheric events or otherwise altered.

COMPLAINTS TO THE COURIER . Damaged products or mismatch of packages: any external damage or mismatch in the number of packages must be immediately reported to the courier, by adding the words 'withdrawal with reserve' on the courier's accompanying document and must also be reported within 24 hours , by sending an email to , they document any breakage in the packaging with demonstrative photos. If you receive damaged goods and have not reported the problem in the manner and times indicated, it is not possible to take charge of any request for compensation for damages.

FAILURE TO COLLECT . In the event of failure to collect the material in stock at the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the customer at the time of the order, the ordered items will be returned to the AgriBio Servizi SRL warehouses . Arrangements will be made for the new fulfillment and additional shipping costs.

Art.4 Cancellation of the order

The Customer can cancel the order by promptly notifying AgriBio Servizi SRL by certified email ( ), email ( ) or by telephone on 0173 70407 no later than 24 hours after receiving the email. confirmation of receipt of the order.

If nothing is communicated, the order is confirmed and taken over by AgriBio Servizi SRL. If the customer communicates late/or does not communicate the cancellation of the order, the customer is obliged to pay for the order in full.

This applies to all payment methods supported by our e-commerce.

Art.5 Right of withdrawal

The Customer's rights are protected by Legislative Decree 206/2005 as amended. The Customer therefore has the right to withdraw from the contract, even partially, without explanation and without additional costs, provided that the withdrawal is communicated by registered letter with return receipt to AgriBio Servizi SRL, Via Generale Cappa 45, Dogliani, 12063 ( CN) or by certified email to , within 14 working days from the day of receipt of the products. The communication can be anticipated, within the same deadline, via e-mail (at ), provided that it is confirmed by registered letter with return receipt within the following 48 hours. This communication must specify the intention to withdraw from the purchase and the product or products for which you intend to exercise the right of withdrawal. The Customer must then return the product at his own expense to AgriBio Servizi SRL, Via Generale Cappa 45, Dogliani, 12063 (CN).

The right of withdrawal is valid except as indicated in the following points:

the right applies to the product purchased by the Customer considering it in its entirety. It is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attachments, moving parts, etc.)

the right of withdrawal does not apply to goods made to measure or personalized, or to goods which by their nature cannot be returned or risk deteriorating or altering rapidly (all plants, seeds, potatoes, biodynamic preparations, bulbs, biodynamic deterrents, cereals, green manures, corn, fertilizers and defense products, fruit and vegetables and products with a shelf life of less than 60 days)

the purchased good must be returned intact, complete in all its parts and packaged in the original and complete packaging (including any documentation and accessory equipment).

in accordance with the law, the shipping costs relating to the return of the goods are borne by the customer.

the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the Customer.

AgriBio Servizi SRL is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments; in the event of damage to the goods during transport, AgriBio Servizi SRL will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain the reimbursement of the value of the goods. In this case, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request.

upon arrival at the warehouse, any damage or tampering to the product not resulting from normal transport procedures will be assessed. if the package and/or the original packaging are damaged, AgriBio Servizi SRL will deduct a percentage from the refund due to the Customer. This percentage (to be understood as a contribution to the restoration costs) cannot however exceed 10% of the same.

If the withdrawal has been exercised in accordance with the methods described, AgriBio Servizi SRL will refund the sum paid for the purchase of the product within 14 working days from the date of return of the goods. Shipping costs will be deducted from the order amount. Only the amount of the compliant goods will then be refunded. AgriBio Servizi SRLe will proceed with the cancellation of the amount charged to the credit card or will issue a bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (ABI Code - CAB - Current Account of the holder).

EXPIRY OF THE RIGHT OF WITHDRAWAL . The right of withdrawal is totally lost due to the lack of the essential condition of integrity of the goods (packaging and its contents), in cases where AgriBio Servizi SRL ascertains even just one of the following deficiencies:

non-diligent use of the goods that has compromised the integrity, or the use of any consumables related to the product;

the lack of the external packaging and/or the original internal packaging;

the absence of integral elements of the product (accessories, cables, manuals, parts, etc.);

damage to the product for reasons other than its transport, including partial or total tampering with the product or parts of it.

In the event of forfeiture of the right of withdrawal, the goods will remain at the headquarters of AgriBio Servizi SRL available to the Customer for collection at his expense.


The goods must be checked upon receipt. Complaints are not accepted after 24 hours from receipt of the goods (packaging, damage, discrepancies). Any complaint must be addressed in writing, by registered letter with return receipt to AgriBio Servizi SRL, Via Generale Cappa 45, Dogliani, 12063 (CN), by certified email to the address agri or by email to the orders address

Art. 6 Payment Methods and Prices

The price of the products will be that indicated from time to time on the site, except where there is an obvious error.

In the event of an error, AgriBio Servizi SRL will notify the buyer as soon as possible, allowing the order to be confirmed at the correct amount or canceled. In any case, there will be no obligation for AgriBio Servizi SRLe to supply what was sold at the lower price incorrectly indicated.

Once the products have been selected they will be added to the cart. Simply follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details may be modified before payment.

Payment can be made via:

1. credit card: the accepted credit cards are Visa and Mastercard. No prepaid cards even if they run on the indicated circuits. Once payment has been completed, the order will be taken over and processed according to the methods and times indicated.

2. Advance bank transfer: the order will be accepted and processed only after the customer has proceeded with the transfer of the amount and/or has sent the payment slip with the CRO inside in advance. This payment method is much longer than the others as it could double the waiting times indicated on the product sheets.

3. Cash on delivery: the order will be taken over and processed according to the methods and times indicated. It is essential to prepare the exact amount for cash payment to the courier.
